Terms of Service

These Terms of Service ("Terms") govern your use of chainTraQR, a blockchain-based supply chain tracking platform operated by Witty Inventions Digital, LLC ("we", "us", "our"). By accessing or using our mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using chainTraQR, you represent that you meet these requirements.

2. Account Registration

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3. Description of Service

chainTraQR provides tools for creating permanent, tamper-proof chain-of-custody records for shipments using blockchain technology. The Service includes:

• Shipment creation and tracking with unique identifiers
• QR code generation and scanning
• Event logging with GPS, photos, and condition assessments
• Immutable record-keeping on the Polygon blockchain
• Public shipment verification

4. Subscriptions and Payment

Access to certain features requires a paid subscription. Subscriptions are billed through Stripe on a monthly basis. By subscribing, you authorize us to charge your payment method at the beginning of each billing period. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

We reserve the right to change subscription pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

5. Blockchain Records

You acknowledge and agree that:

• Data recorded on the Polygon blockchain is permanent and cannot be modified or deleted by anyone, including us
• Shipment IDs are hashed before on-chain recording for privacy, but the existence and timestamps of records are publicly visible
• Photos uploaded to IPFS are stored on a decentralized network and cannot be removed once uploaded
• Blockchain transaction fees (gas) are paid by our relay wallet as part of your subscription; you are not required to hold cryptocurrency

6. Acceptable Use

You agree not to use the Service to:

• Track shipments of illegal goods or contraband
• Submit false, misleading, or fraudulent shipment data
• Interfere with or disrupt the Service or its infrastructure
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Use the Service in violation of any applicable law or regulation
• Resell, sublicense, or distribute the Service without our written consent

7. Intellectual Property

The Service, including its design, code, logos, and content, is owned by Witty Inventions Digital, LLC and is protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

You retain ownership of the shipment data you submit. By using the Service, you grant us a limited license to process, store, and record your data as necessary to provide the Service.

8. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Blockchain transactions will be confirmed within any specific timeframe
• The Service will meet any specific regulatory compliance requirements for your industry or jurisdiction

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITTY INVENTIONS DIGITAL, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Witty Inventions Digital, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Blockchain records created during your use of the Service will remain on-chain permanently.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of the State of Georgia.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
